No. I don't see the giant legal loophole you're talking about. I'll try to be clearer:
  • Placing a fake Craigslist ad to get people to take the belongings of others is a crime. You're committing fraud and conspiracy
  • In your example about your neighbor's lawnmower, you are placing the ad and you are responding to the ad that you know to be fake. That's the crime. Fraud and conspiracy and theft
  • Your bicycle example: "If I see a bicycle I like someone can post a Craig’s list ad and I can use that as my defense?" Who is placing the ad? You? Are you telling a friend to place it? Either way, you know the ad is fake and was placed with the intent of stealing the bike. That's a crime. Same as above
  • Your rape example is ridiculous because you're committing rape. The Craigslist part is irrelevant because you're raping someone (which is a crime)
I don't understand what you're trying to say here. These random people saw a Craigslist ad for free patio furniture. They responded to it (assuming it was real; not sure if they intetacted with someone pretending to be Pat or not) and took the free patio furniture. What crime have they committed?

This exact scenario has happened. A guy posed as his ex girlfriend and posted an ad saying she had a rape fantasy. Some guy fell for the ad and snuck into her house and raped her. Both the ex boyfriend and "rapist" got 60 years.

In pats case his garbage is worthless anyway, I’ve seen nicer furniture on the curb for the garbage truck. Nobody will face consequences for that reason.
"Burden of proof" dude. You would have to prove beyond a reasonable doubt that the person who took the item being advertised knew it was a scam and intentionally took it anyway. As long as they're not breaking the law in the first place (as in your crafty rape idea) they don't need to prove their innocence.
