That seems pretty impossible to track too. Have you ever had shit stolen from your car or yard? When have the cops every done anything or caught the person lol.

No. I don't see the giant legal loophole you're talking about. I'll try to be clearer:
  • Placing a fake Craigslist ad to get people to take the belongings of others is a crime. You're committing fraud and conspiracy
  • In your example about your neighbor's lawnmower, you are placing the ad and you are responding to the ad that you know to be fake. That's the crime. Fraud and conspiracy and theft
  • Your bicycle example: "If I see a bicycle I like someone can post a Craig’s list ad and I can use that as my defense?" Who is placing the ad? You? Are you telling a friend to place it? Either way, you know the ad is fake and was placed with the intent of stealing the bike. That's a crime. Same as above
  • Your rape example is ridiculous because you're committing rape. The Craigslist part is irrelevant because you're raping someone (which is a crime)
I don't understand what you're trying to say here. These random people saw a Craigslist ad for free patio furniture. They responded to it (assuming it was real; not sure if they intetacted with someone pretending to be Pat or not) and took the free patio furniture. What crime have they committed?

"Burden of proof" dude. You would have to prove beyond a reasonable doubt that the person who took the item being advertised knew it was a scam and intentionally took it anyway. As long as they're not breaking the law in the first place (as in your crafty rape idea) they don't need to prove their innocence.

I’m also pretty sure there’s some bullshit about the request being reasonable.

IE you can’t see a post that says EVERYTHING IN THE APPLE STORE TODAY IS FREE JUST WALK OUT WITH IT AND IGNORE STORE SECURITY

Once? Probably not if you just returned the shit. Maybe if they or the DA was pissed, had a political agenda during elections or something.

By the second time probably. Could you hire a lawyer, pay 10-20 times whatever the items were worth and get out of it? yeah maybe. Do you want to trust a jury though? I think it's state by state but most states don't require a public defender for misdemeanors. Commit felony theft or fraud and trust your chances with the jury? I don't think it's worth it. There's easier crimes to make money.


The thing is there's plenty of little like word logic games you can play and the judge doesn't have to give a shit. Yes technically maybe you can be like "aha your honor you see I've trapped you in a logical paradox" and a jury isn't going to understand shit. What are you going to do send a writ to the Supreme Court?

Yeah you can be steadfast and be like you have no proof coppahs hahaha. But they can lie and shit and say they have your ip of the ad or whatever.
