They haven't ruled on qualified immunity yet. The case is being allowed to proceed but it's still really early in the process. If the judge rules qualified immunity doesn't apply, then the lawsuits against the individual cops can go forward. But it's really hard to get around it. There are cases where the police do outrageous shit like steal money or plant evidence and they were still covered by qualified immunity. The cop in this article shot a kid while trying to shoot the family dog. The dog wasn't even a threat. The lawsuit was dismissed because the cop was covered by qualified immunity. The MPD pointing shields at Rick and his frumpy wife isn't in the same universe as shit like that.

One was claiming the MPD is fucked because their cops were “acting like Rambo” in relation to these wellness checks which isn’t close to accurate. First, “Rambo” wasn’t a cop or enforcing the law - maybe John McClaine or Harry Callahan would be a better analogy - and second the extent of them acting like “Rambo” was…knocking on a door and threatened to kick it down if they didn’t open it. No door was damaged in the event so nice Rambo, stupid.

Plus it’s hard to claim “damages” when some of the visits involved them leaving a note. Pat cries “they almost kicked our door down!” Like it’s very serious yet almost means nothing here.

I think the idea is that they showed up to their house 40+ times and were nuisances to them basically despite clearly knowing the calls were fake. For reasons that have been explained numerous times already, the cops are justified in doing this. However it is not so overwhelming that a judge would toss it. So the theory is that the MPD is going to settle to make them go away. Though probably not for what Pat is expecting. And he's going to go down afterwards for ordering the swats himself.

That's completely untrue. If that were the case then every single one of the SWATing calls would have meant guns drawn and multiple cops. Most of the time the merely did wellness checks or talked to Pat through his intercom.

Did you actually read the statement of fact? Go to Count E. This is like the fifth time that Evans responded to the house. Every time, he takes it further than any of the other cops do. He's been briefed repeatedly by his commanding officer in person and by email about Pat's house being a known SWATing house. For Count E, Pat had been SWATed four times the previous day. "Dispatch noted in the CAD, ****Be advised swatting related call**** and “swatting risk at this location—a sgt[.] is to be dispatched with squads to all calls at this location.”" Petersen talked to Pat, "Petersen would later testify that he knew there wasn’t an emergency.". The situation was handled and done with. Then Evans arrived, him and Pat start arguing, then Evans and Petersen start trying to kick the door down.

So Evans knows it's a SWATing house, has been there personally a handful of times, was told that this specific call was a likely SWATing call, is there only because it's a known SWATing call (he's a sergeant and they need one there), the other officer has already handled it and knows there's no emergency, and this dipshit still argues and fights with Pat and tries to forceably enter the home. And reminder, this Statement of Fact is something that both sides have agreed is the truth. These aren't allegations by Pat. MPD agrees they're facts.

Sorry to break kayfabe here but Evans is a complete retard and Pat might actually have some kind of a case against him. I can't imagine any of the other officers facing any consequences but Evans actually might.

Also since his claims of big scary SWATs are for his idiot followers that believe they actually had full a SWAT team for every one of these incidents - even when people pointed out “that sounds like wellness check” or “the fire department checking for a gas leak in the area isn’t a SWAT” he would get all pissed and reply I DEFINE WHAT A SWAT IS, CHILD!

If the city was going to settle they'd have probably done it before spending the money and time on depositions, motions and whatever else they've done so far. And they probably don't want to piss off the entire police force by hanging those individual cops out to dry by not fighting back. The police union wouldn't be too happy about that either. I would die laughing if the thing that made the city fight instead of settle was Rick's autistic need to use people's names when trying to appear intimidating.
