It was at 5k, but will go up as the quash proceeds. The phases will be similar to the SF quash, though it's unlikely that they will get three more chances to waste the courts time. Through a normal 1 round back and forth it will probably be 10-12k. Given there is now precedent from Schulman, a Santa Clara judge will not likely rule any other way.

Going with that assumption it makes sense that his plan was to bully Quasi and overwhelm him with legal costs. Fee-shifting laws, like anti-slapp, do just that. They remove that burden.

For example, Quasi wants to protect his constitutionally protected right to anonymity. He has to file and successfully defend a motion to quash. This can be anywhere from 5k to much more (we've seen 23k here). All it cost is about 80 dollars for them to file another subpoena somewhere else. They can just take a guess about any information Quasi wouldn't want in the hands of someone who has made death threats and all it costs them is 80 dollars. They thought it would force him to fight on multiple fronts, assuming he didn't have the resources to put up initially.

Fee-shifting places that burden on the party it should be on, the one making the claims.

@notalawyer I think is correct. Pat’s lawyer’s strategy seems to be file lawsuit and intimidate the person from not fighting the lawsuit. Pat thought for a loan of 7.5 k getting the sites shut down and get the names of the big players in the Josiah tapes he stated this. He thought that would end it.
This is Pat we are talking about here, what was he going to did when the Quas lawyered up and called his bluff. He bluffed again and went all in.

No surprise that minc law recommends filing in states without them on their website. All other politics aside in California, they have some of the best free speech laws and judges. The "old school liberal" as the opester would say.
Question, if the Santa Clara judge goes the other way, not sure they can with a recent ruling like in SF, but if, that still means Rick owes in SF, but can he negotiate a settlement from that with Quasi?

So in that case Quasi is out 23k but no greater risk (not like this lawsuit is a winner though lol) and Rick claims victory by getting a name, he can't sue.

I don't know why he would do that since Patrick couldn't even come up with a prima facie showing of defamation by quasi, so there's zero chance of anything he could go after him for.
