Will there still be a hearing for the Google Subponea or is it Null since the lawsuit is over?

If you look at the case referenced by Schulman in the decision, this is exactly the circumstances around that appeal.

In Roe v. Halbig, 29 Cal. App. 5th 286 (2018), the California Court of Appeals held that a moving party in a California state court action may prevail within the meaning of section 1987.2 even where a subpoena is withdrawn before the trial court rules on the motion to quash.

Even if they revoke the subpoena the quash remains. As for the hearing, it appears the Minc fund is dry, so I don't think anyone will show up from the plaintiff's side. Most likely one of three things happen:
  1. The judge makes a tentative ruling before the hearing date. He rules in favor of the quash and sanctions and no one contests it (since that would require more legal fees from Minc and Mayr)
  2. The judge's ruling is contested and we see a similar shit show to San Fransisco during the hearing
  3. The judge wants more arguments submitted in a similiar fashion to SF as well.
Three seems unlikely. There's also the possibility they refile in Wisconsin and then send more subpoenas, but that wouldn't do anything to void the sanctions owed here on the original subpoena.

Mr Pena is stating an official record of the result of the SF quash and that the court to be aware of it. There is also some case law aroud decisions in other counties where the facts are the same for the arguments.

As of right now there is a hearing still scheduled and we have the details and the judge assignment.
