So someone with a more Rainman level autism than me might remember otherwise but I'm pretty sure Brinton applied and then it just didn't come to anything. Either he was denied or, as you say, he pussied out because he knew there was zero chance of success anyway and Pat couldn't use the SFWA money to pay him for this one. Great value for money there, Pat.

I believe that he said, either in court or in writing, that he would file to be admitted pro hac vice, but he never followed through and let Stavros Esquire take the reaming from Pena and the judge.

Unless Minc are incredibly, breathtakingly, never-studied-law-at-college incompetent Pat'll have signed a form saying he understands the risks before they took him on as client. It's on him as an alleged adult to ask enough questions before voting signing a contract.

Pat could argue they didn't explain the risks enough, but that's a he-said, pig-said argument that'll be tough to litigate without clear evidence from someone who isn't a world-renowned liar and triathlete.

As a non-lawyer, when I Google "Important First Amendment cases" Krinsky comes up early and often (that decision has been used as guidance in cases in other states; it's pretty fundamental). Pat could maybe sue his lawyers for not anticipating a Krinsky defence - I think his case would have had a better outcome with better planning - but that requires hiring a lawyer to sue a lawyer, and the legal fraternity are deeply reluctant to attack another made man lawyer; so rotsa ruck, fataboy!

It also makes clear that Pat will have waived legal privilege so their lawyer can snuffle through the case. Pat could maybe have a shot at suing that guy for not anticipating Krinsky, although there's no reason to expect the SFWA's lawyer to act in Pat's interest, particularly if the SFWA charge interest on the loan (i.e. it's beneficial to them). I can think of a way Pat can maybe piggly-wriggly out of that obligation, but fuck him, that fat bitch is on his own.

The SFWA legal fund documentation also talks about cases that the SFWA takes on to promote justice in the scifi industry as a whole. In this case it wouldn't just be on behalf of a single member. Mary 3 Names probably approved one of these even though it was in Pat's name arguing that "if they (OnAForums) could do it to me, they could do it to anyone"

Btw how soon can we request SFWA's tax docs and actually see how much they poured into this? Taxes are due in April right, or is that just for individuals.

I highly doubt that any law firm would tell their clients that the case is slamdunk.
They might be vague and try to confuse you but I dont think they leave you the option to sue for malpractise. Specially with a case that stupid.

Also Rick said in tape1 that his lawyers told him it is an uphill battle.
Lawyers are a confident bunch, even when they lose they’re already spinning it and giving you options on how to keep going. Pats team telling him upfront that it’s an “uphill battle” was there way of saying “ok, this is an almost impossible case but we warned you so you can’t get upset when this fails”

He thinks as long as he doesn’t believe he needs to pay quasi nothing will happen because he’s “always right” even though that’s not how the world works. Mentally he’s a teenager and doesn’t understand his actions have consequences. That’s why he keeps saying “wrong as always” because in his mind quasi is the bad guy and Pat is the good guy and good guys always win.

I think this has been a commonly way overstated point on here that everyone honed in on for whatever reason.

At the beginning of the suit Resto said he had “no reason to believe that we were outside of Wisconsin”. That was a lawyerspeak technicality because they didn’t know where anyone is so at that point in the proceedings maybe the Does were in Wisconsin and maybe they weren’t. I don’t think anyone involved believed all 60 were local. Since the case was in Wisconsin they proceed with Wisconsin laws until they have reason to move it somewhere else. Resto was just trying to keep it on track until they could ID anyone and then pursue it wherever they had to. I never thought it was some big lie or a huge deal at all.

I'm assuming Pat had to sign a form drawn up by the SFWA's legal counsel acknowledging that he'd have to pay it back.

If not, and the SWFA decide they're in the business of handing out $100k non-repayable "loans" to their friends without any sort of paperwork, they risk the IRS pulling their charity status and making the organisation pay taxes; and the SFWA officers who made the decision in violation of the org's guidelines could face fraud charges.

Also, Pat will owe taxes on his additional $100k+ of income.

I think it's IRS form 990, and you can just view it online, and I believe it should be covered by one of the SFWA's already lodged filings.

Unfortunately the IRS have a backlog at the moment, and their last online filing is a couple of years old. However, I do go looking for it every couple of months, and I doubt that I'm the only one.

I wonder if anyone's let the IRS know about Pat's potential $100k windfall, paid out to his lawyers? Are there any accountants here? How do the IRS handle money which benefits you but isn't paid to you directly as cash?

I’m not an accountant exactly but you may be onto something here. They may count this as a taxable gift, however it’s the giver of the gift that pays the tax usually, not the recipient.

Anyone who has a CPA doing their taxes this year should ask them that question. Or there’s probably a subreddit for shit like that.
