I was actually sending out an actual online condolence and it said that the website had to approve it first. If the website is first screening and approving it shouldn’t they be the ones being sued?

As long as they removed them once they were requested to, they'd be let off the hook. The onus on the site itself usually stops at removing the offending content.

If I remember correctly 99% of the comments left on the obituary were innocent sounding in-jokes so could easily get through a moderator. It was probably Pat who told his grieving wife that they were not real "thoughts and prayers", but the sarcastic comments of felony cyberstlakers. And then she probably cried afterwards while he neglected to console her but instead brooded on twitter.
